Agreement
By creating an account or using MenuOnScan you agree to these Terms and our Privacy Policy. If you use the service on behalf of a business, you represent that you have authority to bind that business.
Service description
MenuOnScan provides hosted digital menus, QR tools, analytics, and related venue management features. Guest cart functionality is local to the guest device for convenience — it does not transmit orders to kitchen or POS systems unless explicitly stated in a future paid add-on.
Account responsibilities
You are responsible for account credentials, accurate menu content (including allergens and pricing), compliance with applicable hospitality and consumer laws, and activity under your team members' accounts.
Acceptable use
You may not use the service for unlawful content, malware, scraping at scale, circumventing rate limits, or impersonating other venues. We may suspend accounts that threaten platform security or other customers.
Subscription and billing
Paid plans renew automatically until cancelled in billing settings or via Stripe customer portal. Fees are exclusive of applicable taxes unless stated. Refunds are at our discretion except where mandatory law applies. Past-due accounts may lose write access.
Intellectual property
You retain ownership of menu content you upload. You grant us a license to host, display, and process that content to provide the service. MenuOnScan trademarks and software remain our property.
Availability and support
We target high availability but do not guarantee uninterrupted service. Support levels for paid plans are described at /support-sla.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUONSCAN IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE TWELVE MONTHS BEFORE THE CLAIM.
Termination
You may cancel anytime. We may terminate for material breach or non-payment. Upon termination, guest menus may become unavailable; export your data before deletion.
Governing law
These Terms are governed by the laws of Bosnia and Herzegovina unless mandatory consumer law in your jurisdiction requires otherwise. Disputes shall be resolved in competent courts of Sarajevo unless we agree to arbitration in writing.
